On 3rd December 2025 Fenland District Council deemed this planning application to be refused. The application did not include an Environmental Statement under Regulation 11(6) of the Town and County Planning (Environmental Impact Assessment) Regulations 2017 (as amended). Subsequent to issuing the deemed refusal Fenland District Council sought further legal advice on the matter. It has since been confirmed that Fenland District Council no longer adopts the position set out in the letter dated 3 December 2025 with regard to the effect of Regulation 11(6) of the Town and Country Planning (Environmental Impact Assessment) Regulations 2017. In short, the Council no longer considers that there has been a deemed refusal of the application by operation of law. The application is therefore still live and will be progressed by the Council in the usual way.
The Council has written to local residents to inform them of this and also to give a further period for the submission of comments. Any comments already received will be taken into account when determining the application.
