Kim Winterton presented the Street Trading Policy - Consultation Responses Report and informed Members that:
- Adoption of Schedule 4, Local Government (Miscellaneous Provisions) Act 1982;
- Licensing Committee met on 30 June 2014 to discuss proposals for a Street Trading Policy. Committee agreed to consult Town and Parish Councils on the draft Street Trading Policy;
- Licensing Committee met on 14 October 2014 to review Town and Parish Council responses. Committee decided that a Street Trading Policy for the Fenland District Council would go to public consultation for a period of 12 weeks;
- Consultation took place between 12 December 2014 and 6 March 2015.
- No responses to the public consultation had been received
Kim Winterton added that two amendments had since been made to the draft policy, page 19, last line, "There is no right of appeal to the Magistrates Court" be deleted and the following paragraph on page 20 starting "A person aggrieved by a decision....." also be deleted.
Kim Winterton also suggested that the policy be reviewed annually in order to update and add any new streets.
Councillor Miscandlon asked that Ward Alerts be sent out to relevant Members when an application is received to which Kim Winterton confirmed this would happen.
Councillor Mrs Mayor asked if there was any indication as to what the fees would be set at to which Kim Winterton explained not presently, but these would need to be agreed before the policy is submitted to Full Council. Rory McKenna suggested that it could be agreed that these are set at the cost to the council.
Councillor Owen proposed the recommendation and this was seconded by Councillor Oliver.
It was AGREED that the draft policy be recommended to Council.
