L7/14 TO CONFIRM AND SIGN THE MINUTES OF THE MEETING OF 14 OCTOBER 2014
The minutes of 14 October 2014 were confirmed and signed.
L8/14 REVIEW OF CUMULATIVE IMPACT ZONE POLICY

Kim Winterton presented the Review of Cumulative Impact Zone Policy report and informed Members that:


  • Full Council adopted the CIZ Policy on 20 June 2013;

  • This CIZ special policy sits as an appendix to the Council Statement of Licensing Policy;

  • The Council, as the Licensing Authority, has a statutory duty to review its Statement of Licensing Policy every 5 years.  This process starts again this year ready for the policy to be in placed for January 2016 and evaluation of the CIZ should take place before the consultation begins.


Members took part in an in-depth discussion regarding the Cumulative Impact Zone.


It was agreed to duly authorise officers to follow the consultation procedure

L9/14 AMENDMENT TO THE SCHEME OF DELEGATION WITHIN THE COUNCIL'S CONSTITUTION

Kim Winterton presented the Amendment to the Scheme of Delegation within the Council's Constitution Report and informed Members that:


  • The Licensing Act 2003 has been amended by the Police Reform and Social Responsibility Act to give the status of Responsible Authority to the Licensing Authority;

  • The proposed amendments and additions to the scheme of delegation will improve the efficiency of the licensing service;

  • The amendments of the schemes of delegation will reduce the risk of legal challenge to the licensing process;

  • This report has been submitted after a request from Members at a recent Licensing Hearing.


Members made comments, asked questions and received responses:


  • Is it possible for Members to receive Ward Alerts for Licensing to which Kim Winterton stated that although a Ward Member could receive a ward alert licensing, there are a number of them that Members would not be able to act on, unlike Planning; as Members are limited to what they can do under the Licensing Act.  Kim Winterton stated she would be happy to circulate these if they were for information only;


It was AGREED that:


  • The recommended additions and amendments for delegations under the Licensing Act 2003 as detailed within the report be APPROVED and recommended to Full Council for approval;

  • The new responsibility be delegated to the Corporate Director and for the responsibility to then be further sub-delegated to the Licensing Manager

L10/14 LEGISLATION UPDATES (VERBAL)

Kim Winterton gave a verbal update on The Legislative Reform (Entertainment Licensing) Order 2014.
